The 457 visa is a temporary visa which, if granted, can allow for a stay of up to four years.
A sponsoring employer must 'nominate' a position for the potential employee.
The 457 visa is most commonly used by employers to sponsor 'approved' skilled overseas workers to work in Australia on a temporary basis.
Employers can be either, Australian businesses or overseas businesses.
The visa allows for multiple entry and secondary applicants.
Employers must be 'approved' as an eligible sponsor. The occupation must be an eligible 'nominated' occupation and the employee an eligible 'nominated' employee.
The process for obtaining a Subclass 457 is made up of the following steps:-
- Employer applies to be a sponsor.
- Employer nominates the occupation to be filled.
- Employer recruits overseas workers to fill nominated positions.
- Employee accepts the offer of employment and applies for visa.
- Employer acts as a sponsor for employee applying for a visa.
- There are validity periods for sponsorship and nominations.
If an employee wants to apply for a new visa (because their current visa is about to expire), they must lodge a new visa application.
From 14 September 2009, 457 visa holders who wish to change employer or position (within the validity of their current visa) will not be required to apply for a new Subclass 457 visa.
The 457 visa is a useful vehicle for potential migrants who cannot successfully secure a permanent visa under the General Skilled Migration program, as it can lead to other visa pathways after a period of time.
